After DFO decided to grant no offsetting credit for more than 1 km of river relocation, the contractor in the design build team made a claim against the designer for more than $20M. Both parties agreed to mediation rather than go to court.  5SSR was retained by the design firm’s attorney to determine the extent to which the designer was responsible for the problem.  5SSR reviewed all available background information (RFP, Contracts, Terms of Reference, Correspondence) and design drawings and, with their attorney, developed a strategy to defend the designer. While the results of the mediation are confidential, the designer’s attorney reported that 5SSR’s research and opinion was key to reaching a settlement.
